This Privacy Policy (“Privacy Policy”) applies to our store, websites, applications, or website features you use or access (collectively, the “Sites”), as well as any mobile application (each, an “Application” and together with the stores, Sites and Applications, are referred to as the “Services”).  By using our Services, you agree to the use, disclosure and procedures this Privacy Policy describes, which is incorporated into our Terms and Conditions.

Please note that this Privacy Policy does not apply to third-party services (each, a “TPS”), such as Facebook, Amazon, Google, Trainerize or other social network services and commercial partners of Jag Total Fitness LLC.   We are not responsible for their practices, content, or privacy policies. We encourage you to carefully review the privacy policies of any TPS you access so that you know how they will use and share your information.

Information Collected or Received

We collect your personal information in order to provide and continually improve our Services.  Personal information we may collect from you includes but is not limited to:

  • Your name and email address when signing up to create an account
  • Your credit card information when completing an order
  • Your shipping and billing address when completing an order
  • Your age, gender, image and pertinent health information when completing the Health and Fitness Questionnaire.
  • Identifier and other technical information, such as your browser information, operating system information, device information, IP address, and the date, time, length of stay and specific pages accessed during your interactions with the Services

We maintain one or more databases to store your personal information and may retain it as reasonably required to serve you and operate the Services. Personal information that we collect depends on how you use the Services. Providing your personal information to us is your choice. If you choose not to provide us with certain personal information, you may not be able to take advantage of many features of the Services.  We may aggregate your personal information with information collected from other users to (i) provide you with a better experience, (ii) improve the quality and value of the Service and (iii) analyze and understand how our Services are used.

Members of our team have access to the information you provide us.  Our team members have access to this information to help fulfill orders, process refunds and support you.For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Age Of Consent

COPPA (Children Online Privacy Protection Act) – When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.  We do not specifically market to children under the age of 13 years old.  

Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”).  We do not knowingly collect personally identifiable information from anyone under the age of 18. We encourage parents to talk to their children about their use of the Internet and the information they disclose to websites. By using this site, you represent that you are at least the age of majority in your state or province of residence.   If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. How Information Is Collected

We may collect your information in the following ways:

  • .When You Provide Us With Information to Make a Purchase – If you use our Services to make a purchase, we may request certain personal information from you to facilitate the transaction. We may collect certain financial information from you, such as your credit card information. We store only a very limited portion of your credit card information, in a manner that is generally permitted by credit card issuers. Our payment processing partner stores and processes your credit card or other payment information using industry-standard security measures. By making a purchase through the Services, you give us consent to use and provide your financial information as we consider necessary to process the transaction.
  • Communications You Initiate with Us – If you contact us in person, by phone, email, instant message, live chat, social media, or by some other means (either through our Services or through TPS), we may keep a record of your contact information and correspondence for later reference. When we send you emails, we may track whether you open them to figure out how to deliver more delightful and helpful emails and improve our Services. Completion of our Health and Fitness questionnaire, tracking your successes through our program, testimonials, success stories, images we may track in order to help you achieve your desired goals.
  • Third-Party Services – -If you create your Jag Total Fitness, LLC account by connecting through a TPS, such as Amazon or Facebook, Trainerize, you are authorizing us to use public information from that connected account to help complete your Jag Total Fitness, LLC profile. We collect and store this information and use it to help you connect to our Site. Connecting your Jag Total Fitness account to a TPS is completely optional, and you will have the opportunity to grant permission when you attempt to connect. Please remember that the manner in which the TPS uses, stores, and discloses your information is governed solely by the policies of such service. We recommend that you review the terms and policies of that TPS, including its privacy and data gathering practices. Jag Total Fitness shall have no liability or responsibility for the privacy practices or other actions of any TPS or any other third-party site or service that may be enabled within the Service.
  • Jag Total Fitness partners with TPS who set cookies and tracking pixels for Site visitors and members on our behalf in order to deliver their services. These services include targeted online marketing and analysis of data collected through cookies. These TPS technologies allow a partner to recognize your computer or mobile device each time you visit JagTotalFitness.com or other sites that also utilize the TPS, but do not allow access to personal information from Jag Total Fitness, LLC. TPS may choose to include Jag Total Fitness, LLC widgets on their sites. When you load a site that has chosen to include our widgets, we receive analytics information through a cookie that may be used to enhance our data or to improve our Services. Jag Total Fitness does not have access to or control over these TPS technologies, and they are not covered by our Privacy Policy.
  • Information We Automatically Collect – Like most websites, our Services may incorporate technology such as “pixel tags”, “web beacons” and “cookies” which allow us to track the actions of users of our Services. Pixel tags or web beacons are tracking devices on websites or in emails that can monitor the behavior of the user visiting the website or sending the email. Cookies are small files placed on your computer that recognize you when you return to Jag Total Fitness, LLC and that allow us to customize your user experience and improve the Jag Total Fitness, LLC service. You may modify the cookies that are accepted by your computer by changing your browser settings, although this may change the way the Jag Total Fitness, LLC website is presented to you. Other companies’ use of their cookies is subject to their own privacy policies, and we have no obligation to inform you of third-party cookies that are set.
  • Jag Total Fitness, LLC uses cookies to keep track of your shopping cart and for other personalized experiences. We also use tracking technology to create remarketing audiences of users based on visitor behavior on our Sites. Jag Total Fitness, LLC may also deliver custom ads based on your affinities, interests, geographic and demographic signals. Jag Total Fitness, LLC may use other TPS or services such as Google Analytics to monitor activity on the Site and to assist with advertising.

COOKIES, PIXEL TAGS/WEB BEACONS, ANALYTICS INFORMATION, AND INTEREST-BASED ADVERTISING

 We, as well as third parties that provide content, advertising or other functionality on our Services, may use cookies, pixel tags, local storage and other technologies (“Technologies”) to automatically collect information through the Services. We use Technologies that are essentially small data files placed on your computer, tablet, mobile phone or other devices that allow us to record certain pieces of information whenever you visit or interact with our website, services, applications, messaging and tools, and to recognize you across devices.

  • Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Site may not work properly.
  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded on the Site that collects information about users’ engagement on that web page. The use of a pixel allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement.
  • Social Media Widgets: The Site includes social media features such as links to Facebook, Instagram, Twitter, YouTube and LinkedIn (that might include widgets, such as, the share this button or other interactive mini-programs). These features may collect your IP address, which page you are visiting on the Site and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on the Site. Your interactions with these features are governed by the privacy policy of the company providing it.
  • We may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on some of our Services and to develop website content. Our uses of such Technologies fall into the following general categories:

This includes Technologies that allow you access to our Site, Services, applications, and tools; that are required to identify irregular site behavior, prevent fraudulent activity and improve security; or that allow you to make use of functions such as shopping carts, saved search or similar functions.

We may use Technologies to assess the performance of our Site, applications, Services and tools, including as part of our analytic practices to help us understand how our visitors use our Site, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our website content, applications, services or tools;
  • Functionality Related. We may use Technologies that allow us to offer you enhanced functionality when accessing or using our Sites, Services, applications or tools. Please note that blocking, deleting, or disabling these Technologies will affect the functionality of our Sites, Services, applications and tools, and may prevent you from being able to access certain features.

Passive Information Collection

  • As you navigate through a website, certain information can be passively collected (that is, gathered without your actively providing the information) using various technologies and means, such as Internet Protocol addresses, cookies, Internet tags, and navigational data collection.
  • This Website may use Internet Protocol (IP) addresses. An IP address is a number assigned to your computer by your Internet service provider (ISP) so you can access the Internet and is generally considered to be non-personally identifiable information, because in most cases an IP address is dynamic (changing each time you connect to the Internet), rather than static (unique to a particular user’s computer). We use your IP address to diagnose problems with our server, report aggregate information, determine the fastest route for your computer to use in connecting to our Website, and administer and improve services to our consumers.
  • A “cookie” is a bit of information that a website sends to your web browser that helps the website remember information about you and your preferences. This Website uses cookies.
  • “Session cookies” are temporary bits of information that are erased once you exit your web browser or otherwise turn your computer off. Session cookies are used to improve navigation on websites and to collect aggregate statistical information. This Website uses session cookies.
  • “Persistent cookies” are more permanent bits of information that are placed on the hard drive of your computer and stay there unless you delete them. This Website uses persistent cookies.
  • “Internet tags” (also known as pixels, single-pixel GIFs, clear GIFs, invisible GIFs, and 1-by-1 GIFs) are smaller than cookies and tell a website server information such as the IP address and browser type related to the user’s computer. This Website uses Internet tags.
  • “Navigational data” (log files, server logs, and clickstream data) and Internet tags are used for system management, to improve the content of a website, market research purposes, and to communicate information to users. This Website uses navigational data.

As noted above, you may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note that cookie-based opt-outs are not effective on mobile applications. However, on many mobile devices, application users may opt-out of certain mobile advertisements via their device settings.

  • The online advertising industry also provides websites from which you may opt-out of receiving targeted ads from our data partners and our other advertising partners that participate in self-regulatory programs. You can also choose not to be included in Google Analytics here.
  • To be clear, whether you are using our opt-out or an online industry opt-out, these cookie-based opt-outs must be performed on each device and browser that you wish to have opted-out. For example, if you have opted-out on your computer browser, that opt-out will not be effective on your mobile device. You must separately opt-out on each device. Advertisements on third party websites that contain the AdChoices link, and that link to this Privacy Policy, may have been directed to you based on anonymous non-Personal Information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt-out of the advertising partners’ use of this information for interest-based advertising purposes.  

OPTING OUT

 If you decide you do not want to receive marketing emails, you can select to “opt-out” by following the unsubscribe instructions in the email. Unsubscribing will stop you from receiving most types of communication, but it may not apply to emails about orders or transactions you place through the Services or to respond to your specific request, such as password recovery.  You may also request to “opt-out” by sending your request to stop receiving most types of communications to Jagtotalfitness@gmail.com.

Blogs, Reviews and Testimonials

 The Services may from time to time offer publicly accessible blogs, customer reviews, media, photos or testimonials.  Any information you provide in these areas may be read, collected and used by others who access them. To request removal of your personal information from our blogs, customer reviews or testimonials, please contact us at JagTotalFitness@gmail.com. Please note that in some cases we may be unable to remove your personal information. 

How Information Is Used

 We primarily use the information we collect to enhance the Services and your experience. Except if we sell all or a portion of our business, as described below, we do not sell your personal information to anyone. If we share your personal information, we do so as described below.

  • We may share your personal information with TPS providers, commercial partners, service providers, and others we conduct business with to: (i) enhance our Services and evaluate the effectiveness of our partnerships; (ii) provide you with additional services related to our Services; (iii) conduct quality assurance testing; (iv) facilitate creation of accounts; (v) provide technical support; (vi) market the Services; (vii) facilitate business partnerships with trusted partners and/or (viii) to provide other services to Jag Total Fitness, LLC.
  • Surveys and Reviews – From time to time, we (or third parties acting on our behalf) may contact you to participate in research, surveys or beta testing or to provide reviews and testimonials. If you decide to participate, you may be asked to provide certain information, which may include Personal Information. All information collected from your participation in our research, surveys, reviews or testimonial process, or beta testing is provided by you voluntarily. We may use such information to improve our products, our Site and/or Services, and in any manner consistent with this Privacy Policy.

Payments

We accept payments through PayPal a direct payment gateway.  We will not store or collect your payment card details. That information is provided directly to PayPal, our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.  When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.  PayPal stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.  All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Agents

 Generally, we will not disclose your personal information to an unaffiliated third-party. However, we may provide your personal information to our employees, contractors, commercial partners, agents, service providers and designees (“Agents”) to enable them to perform certain services for us including without limitation: order fulfillment, payment processing, website-related services such as web hosting, database management, improvement of website-related services and features, maintenance services and distribution of offers, business partnerships, partner promotions, advertisements and other marketing materials on our behalf.  We may also provide our Agents with non-identifying or aggregate information indicating the demographic information of users on our Website, buying behavior, and opportunities to market to select segments of our users indirectly. When we share non-identifying or aggregate user data, it is done in a way that it cannot be linked with your personal information.

How We Respond to Do Not Track Signals

 Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a “Do Not Track” (“DNT”) or similar feature to signal that a user does not want to have his or her online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser’s user. This Site does not comply with Federal DNT legislation.

Use of Services via Mobile Device

 If you use the Services through your mobile device, we may receive a unique identifier or information about your location. You may at any time prevent the Services from using your location by turning this option off at the device level. When you use the Services through your mobile device, we also collect device type and UUID, a unique identifier generated within the Application, and store this information in log files and system databases. We use this information to provide you with the most up to date application and features, or to advertise or promote products or services to you that are applicable to your device type.

Business Transactions and Transfers, Merger, Sale, or Other Asset Transfers.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. In such event, Jag Total Fitness, LLC  will endeavor to direct the transferee to use Personal Information in a manner that is consistent with the Privacy Policy in effect at the time such Personal Information was collected.  If an acquirer that has assumed all or part of our business materially alters how it uses or shares your personal information than at the time of initial collection, the acquirer will provide prior notice of the new or changed practice.

Compliance with Laws and Law Enforcement

Jag Total Fitness, LLC cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process, to protect our rights or the rights of our users or others, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be illegal, unethical or legally actionable activity. We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to accomplish the foregoing.

International Users Consent to Transfer

The Service is hosted in the United States. If you are visiting the Service from outside the United States, your information may be transferred to, stored and processed in the United States in accordance with this Privacy Policy and applicable United States laws. Please note that data protection and other applicable laws of the United States may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. By using the Service, you consent to transfer of your information to our facilities as described in this Privacy Policy.

Without limiting the terms of our Terms and Conditions and this Privacy Policy, you understand that we do not guarantee that your use of the Site and/or information provided by you will be private or secure and we are not responsible or liable to you for any lack of privacy or security you may experience. You are fully responsible for taking precautions and providing security measures best suited for your situation and intended use of the Site. You also understand that any information provided by you or collected by us or our Agents in connection with your use of the Site will be used in the manner described in our Terms and Conditions.  Any information that you provide to us is done so entirely at your own risk. We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our “Website” and/or “Services”.  Google’s advertising requirements can be summed up by Google’s Advertising Principles. For example, anonymous information collected across multiple Internet sites that you visit over time may enable the ad network to predict your preferences and show you ads that are most likely to be of interest to you. Some of these networks may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program. Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports “Website” and/or “Services”.  traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. 

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt Out page or by using the Google Analytics Opt Out Browser add on.

CAN SPAM Act

 The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.  We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions
  • Process orders and to send information and updates pertaining to orders
  • Send you additional information related to your product and/or service
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred

To be in accordance with CANSPAM, we agree to the following:

  • Identify the message as an advertisement in some reasonable way

This California Consumer Privacy Notice (the “Notice”) supplements Jag Total Fitness, LLC’s Privacy Policy.  Jag Total Fitness, LLC has prepared this Notice to inform California residents of (1) how we collect, use and disclose personal information, and (2) the privacy rights California residents have relating to their personal information.  All capitalized but undefined terms have the meanings set forth in the Privacy Policy.  Jag Total Fitness, LLC does not sell your personal information as we understand sale to be defined by the CCPA.  We may share personal information in connection with a business transaction or transfer as described in our Privacy Policy.

Verification 

In order to protect your Personal Information from unauthorized access or deletion, we may require you to verify your identity.  If we cannot verify your identity, we will not provide or delete your personal information.

You may submit a request to know or a request to delete your Personal Information through an authorized agent.  If you do so, the agent must present signed written permission to act on your behalf.  You may also be required to independently verify your identity with us.

Retention of Data

 We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.  We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

 We review this Privacy Policy at least once every 12 months to make sure it complies with applicable law and conforms to changes in our business.
